Personal Injury Practice
A large portion of the firm's practice is devoted to personal injury, specifically, representing plaintiffs and claimants in the following types of claims:
- Motor Vehicle Accidents
- Personal Injury Practice
- Uninsured/Underinsured Claims
- Medical Malpractice
- Product Liability
- Premises Liability
- Workers' Compensation
Hirsch Law LLC practices law with the utmost levels of professionalism and respectability and prides itself on separating itself from those personal injury attorneys that compromise the integrity of the profession. For example, the firm strongly opposes the filing of any lawsuit that is frivolous. As stated in our firm's Core Philosophy, no one benefits from these types of lawsuits.
Motor Vehicle Accidents
Thankfully, in a large number of accidents, most of those involved escape without injury. Unfortunately, there are many times when motor vehicle accidents can cause injuries that have a dramatic effect on someone's life. There is nothing more upsetting and frustrating than being injured as the result of another driver's carelessness and negligence. We represent drivers, passengers and pedestrians injured in motor vehicle accidents. Our cases involve all degrees of injuries ranging from mild strains to broken bones, and sadly, cases involving death. There are no routine cases. All cases will receive the attention they deserve. In addition, as noted in our firm's Core Philosophy, we treat and respect all clients equally regardless of case value.
Uninsured Motorists (UM) / Underinsured Motorists (UIM) Claims
Often times adding to the upset of being injured as the result of someone else's careless driving is finding out that the careless driver is not adequately insured, or not insured at all. Attorney Hirsch represents clients faced with this situation, and will pursue a claim based on uninsured or underinsured motorist coverage when coverage is available.
Medical Malpractice
The concept of bringing a lawsuit against a hospital or healthcare provider is often times a difficult one to accept because, in general, healthcare providers are dedicated to helping us. Nevertheless, there are times when severe medical errors, including some that are reckless, can have a profound effect on someone's life. Unfortunately, the only relief available to a victim of medical malpractice is to pursue a claim which will typically be vigorously defended and almost always involve protracted and costly litigation. Because of the costly and time-consuming nature of medical malpractice cases, we screen each case very carefully. We will not accept a case simply because there was a bad medical result. Bad results happen, and in most cases, it is through no fault of the healthcare provider. But when the bad result occurs because of negligent or reckless conduct and that conduct produces life-changing injuries or death, a lawsuit may be necessary.
Attorney Hirsch spent his first four years of practice defending medical malpractice lawsuits against Connecticut and New York's largest hospitals, and against hundreds of physicians. Having seen firsthand how these cases are defended and how insurance companies handle certain claims, Attorney Hirsch has used this experience to bolster his current practice of representing plaintiffs. Product Liability
Product liability claims involve injuries caused as the result of defective products. The claims are usually time-consuming and costly, and defended vigorously by large companies. They involve the use of experts retained by both sides to evaluate the safety of the product. Hirsch Law LLC is experienced to handle these claims, including those related to air bags, tires, medical devices, or any defective product that causes a serious injury.
Premises Liability
Hirsch Law LLC also represents clients injured on the property of another where the injury was caused by the negligence of the property owner or someone else responsible for the care of the property. The occurrence of an injury alone is not sufficient to create liability. There must be negligence such as failing to timely remedy a defect, or failing to warn of a defective condition, that exists on the property. In evaluating these claims, we take into account the role of the prospective client's own personal responsibility. We will only accept claims where the property owner or representative of the owner was negligent in caring for its property, whether the owner is an individual, local business, a municipality or even the State.
Workers' Compensation
Typically, employees injured at the workplace are entitled to workers' compensation benefits. Hirsch Law LLC represents employees beginning with the initial filing of the claim, the investigation of the claim and throughout all phases of the process, including representation at hearings.
Attorney Hirsch also represents employers at the Workers' Compensation Commission with regard to compensation claims as well as claims based on discrimination and wrongful discharge allegedly based on work-related injuries.
